Terms and Conditions for District Connect Application

Welcome to the District Connect application ("Application") provided by Heritage School District ("we," "us," or "our"). By accessing or using this Application, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Application.

1. Acceptance of Terms

By creating an account, accessing, or using the Application, you agree to these Terms, our Privacy Policy, and any additional guidelines or rules provided by us. These Terms apply to all users, including parents, guardians, or other individuals using the Application to enroll students, pay tuition, or request reimbursements.

2. Eligibility

To use the Application, you must:

• Be at least 18 years of age or have the consent of a legal guardian.
• Be a parent, guardian, or authorized representative of a student enrolling in Heritage School District.
• Provide accurate and complete information during the registration process.

3. Account Registration

To access certain features of the Application, such as enrolling a student, paying tuition, or requesting reimbursements, you must create an account. You are responsible for:

• Providing accurate and up-to-date information during registration, including your first name, last name, email address, and any other required information.
• Maintaining the confidentiality of your account credentials (e.g., email and password).
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if we suspect fraudulent activity or a violation of these Terms.

4. Enrollment, Tuition Payments, and Reimbursements

The Application allows you to:

• Submit enrollment applications for students.
• Other features that will be added as time goes on.

By using these features, you agree to:

• Provide accurate information about yourself and the student and any payment or reimbursement requests.

5. Payment Terms (coming later))

• All payments must be made through the Application using the provided payment methods (e.g., credit/debit card, bank transfer).
• You are responsible for ensuring that your payment information is accurate and up-to-date.
• All payments are non-refundable unless otherwise stated in our refund policy or required by law.
• We use third-party payment processors to handle transactions. By making a payment, you agree to the terms and conditions of the payment processor.

6. User Conduct

You agree not to:

• Use the Application for any unlawful or unauthorized purpose.
• Share your account credentials with others or allow unauthorized access to your account.
• Submit false or misleading information during enrollment, payment, or reimbursement processes.
• Engage in any activity that disrupts or interferes with the functionality of the Application, including introducing viruses, malware, or other harmful code.

We reserve the right to investigate and take appropriate action, including suspending or terminating your account, if we suspect a violation of these Terms.

7. Intellectual Property

All content on the Application, including text, graphics, logos, and software, is the property of Heritage School District or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or modify any content from the Application without our prior written consent.

8. Privacy

Your use of the Application is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Application, you consent to the collection and use of your information as described in the Privacy Policy.

9. Termination

We may suspend or terminate your access to the Application at our sole discretion, with or without notice, if:

• You violate these Terms.
• We suspect fraudulent or unauthorized activity on your account.
• We discontinue the Application or specific features.

Upon termination, your account and access to the Application will be deactivated, but you will remain responsible for any outstanding tuition payments or obligations.

10. Limitation of Liability

To the fullest extent permitted by law, Heritage School District and its affiliates, officers, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Application, including but not limited to:

• Errors or delays in processing enrollment, payments, or reimbursements.
• Loss of data or unauthorized access to your account due to your failure to secure your credentials.
• Interruptions or unavailability of the Application.

11. Indemnification

You agree to indemnify and hold harmless Heritage School District and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Application, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the state in which Heritage School District is located, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Application will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Application or sending you an email notification. Your continued use of the Application after such changes constitutes your acceptance of the updated Terms.
